Terms of Service

These terms govern your use of the iworXout mobile app and services provided by The WORXOUT. By creating an account or using the app, you agree to them.

1. Who we are

iworXout is operated by The WORXOUT LLC, 5825 Covington Rd, Fort Wayne, IN 46804 ("The WORXOUT," "we," "us"). You can reach us at erin@theworxout.com.

2. Eligibility & accounts

You must be at least 18 years old to use iworXout. You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for activity that occurs under your account. Full access to programming and coaching features requires an active WORXOUT membership.

3. Health & medical disclaimer

iworXout provides fitness, nutrition, and wellness information and coaching for general informational purposes. It is not medical advice and is not a substitute for care from a qualified healthcare professional. Always consult your physician before beginning any exercise or nutrition program, especially if you have a medical condition or are pregnant. You participate in any activity at your own risk, and you assume responsibility for your own health decisions.

4. Acceptable use

You agree not to misuse the app. In particular, you will not:

• Access another person's account or data without authorization.
• Attempt to disrupt, reverse engineer, or compromise the security of the app.
• Use the app for any unlawful purpose or to harass others, including coaching staff.
• Upload content that is unlawful, abusive, or infringes others' rights.

5. Your content

You retain ownership of the data and content you log in the app (such as workouts, biometrics, nutrition, and journal entries). You grant The WORXOUT permission to store and process that content solely to provide and improve the service and your coaching, as described in our Privacy Policy.

6. Memberships & payments

Membership terms, pricing, and billing are governed by your separate membership agreement with The WORXOUT. The app may surface scheduling and program information tied to your membership. We are not responsible for charges made through third parties outside the app.

7. Account deletion

You may delete your account at any time from Settings in the app, or by emailing erin@theworxout.com. Deleting your account removes your personal data and logs as described in our Privacy Policy.

8. Availability & changes

We work to keep the app available and accurate, but we provide it on an "as is" and "as available" basis without warranties of any kind. We may modify, suspend, or discontinue features at any time.

9. Limitation of liability

To the fullest extent permitted by law, The WORXOUT will not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Nothing in these terms limits liability that cannot be limited under applicable law.

10. Governing law

These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules.

11. Changes to these terms

We may update these terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the app. Continued use after changes means you accept the updated terms.
